Hi all, I was hoping that I could get some guidance as to how I should proceed with this. Thank you in advance. The accident occurred 7 days ago in CA. I was driving home from work in the 4th lane of a 4 lane highway. There was a gap of approximately 4~5 cars in the 3rd lane, so I switched into that lane. By the time I finished the lane change, there was approximately 3~4 cars distance between me and the car behind me. I then drove for approximately a 100 yards, at which point the traffic suddenly slowed and I decelerated. The guy behind me, however, seems to have been looking elsewhere and rear ended me. However, before he collided, he managed to swerve his car and hit the corner of my rear bumper with the corner of his front bumper. We pulled over to the side of the road and exchanged information. It turns out that he does not have a driver's license (or any California/U.S. ID; he showed me a Mexican ID). He begged me not to call the police, admitted fault and said that he would settle it through his insurance (he is insured with a VERY shady place called Access General). I took pity on him, especially since it was very likely that he is an illegal immigrant, so I just took his information down and moved along. Fast forward a few days, and I find out that he has told his insurance that I cut in front of him and that he is not at fault. Since there are no witnesses or a police report, his insurance takes his side. Meanwhile, since I only have liability with Geico, they are saying that they can't help me. The damage to my car is between $4~5k, and that is not even taking into account devaluation of the car's value. I feel very cheated because I took pity on him and I am rewarded with a repair bill that nobody wants to deal with. I have called him multiple times and asked him to tell the truth, but he just ignores me. I am now very angry and want to do 2 things: 1. Get my car repaired. 2. Screw up his life. Hopefully get him deported (very strong liklihood of him being an illegal immigrant), or at the least bankrupt him. I took pity on him because he was in a time of need. All he had to do was tell the truth to his insurance, but he was afraid that his monthly bill would go up... so he lies and screws me instead. Alone this is not inherently a problem, however, the government now mandates the acquirement of insurance, which changes (or should change) the business's status from that of being privately owned. Point being, if you MUST have it, then the rate must be based on the sole individual owenership of the insurance, e.g. driving experience, amount of accidents, car safety rating, etc. The same bias would be exacted in saying that African American people are more likely to have an accident than Caucasion people, but that would have a 0% chance of standing in any public eye or court of law. This action might be legal, but it is inarguably injust and should not be legal under any circumstance. Discrimination is rampant enough throughout society, and certainly should not be introduced into the corporate or political world. Unfortunately this question is leaning on the brink of a rant, which is prohibited by the guidelines, so it shall be continued only for a short while. The basic question is simple. When will something be done about it, who will do it, and how will they do it. I would undoubtedly challenge its legality myself, and still might in days to come, but unfortunately my age does not coexist well with my ambition, aptitude, or will. I had a minor car accident in a Costco parking lot last weekend. I was backing out my parking lot; the other guy was also backing out. Unfortunately, we didn't see each other... Anyway, this seems to be a 50-50 accident. The damage to the cars are moderate and we agreed on just fixing ourselves. So no personal information was exchanged. I got an estimate today. So I plan neither to report to DMV nor to file a claim. But one friend of mine suggested that in this case, I should still notify (but not to file a claim to) my insurance company. His argument is that the other party can still come back and sue me (if he is a freak). While we didn't exchange information, the other party may have remembered my license plate number so theoretically he could find out all other information about me. First off I am in CA and the other liable insurance is Farmers or 21st century. For some reason Farmers is handling the claim. Ok, so I was in an accident in which the other party was at fault. As such their insurance has accepted liability. I have already taken my car get an assessment by one of their representatives at a repair place. But do to their stupidity in a few instances, its taking a long time for them to make a decision as to repair my car or call it a total loss. So because of that, in the mean time I am forced to drive my car which I do not feel comfortable driving in. The passanger seat belt doesn't work so I can't commute to school like I usually do. Bottom line is a have been patient when they did their investigation and everything, but its been a while now and my car is still not even in a shop to get fixed. In order to maybe speed up the process and make me feel safer, can I just get a rental car already force the other insurance to pay? After all they are completely liable since it was their driver that was at fault. Why do I have to wait day after day, driving a ruined car, while they take their sweet time making their BS decisions? I know that they legally have to pay for a rental while my car gets repaired, but again they are taking time simply deciding if its a loss or not. So because of them, its not in a shop just yet...., but can I still get a rental car early and have them pay anyway? Maybe that will make em hurry up.

Maybe I'm missing something here, but the way it's been explained to me is this: I've got a $500 deductible on my policy. If someone backs into my parked car, this will be deducted from the payout I get for repairs. OK, let's say the damages amount to $900. That would mean that because of MY $500 deductible, the payout to me would be $400. I'd have to pay the other $500 out of pocket to repair my car. The insurance company would then reclaim that $400 from the other guy's insurance company. Now, if the other guy also has a $500 deductible (very likely), then he'd have to pay $400 out of pocket. That seems wacked to me. Someone damages my car, and he has to pay LESS than I do for the damages. Am I missing something?

I'll explain a little more. I own a duplex which I rent out the top of while my husband and I live down stairs. The renters upstairs have been my friends for a long time and they needed an apartment so we rented to them for $535 a month. After a year we agreed to trade daycare for rent so I could go back to work full time. The kids are upstairs from 11am to 5:30pm and she refuses to take them earlier even though if she did I could get a better schedual. I trust the woman and her son is the same age as my oldest. Need advice on qualifying for subsidized health insurance?

I'm an older full-time college student and my husband works full-time at Walmart. In the past three years, I've been through 4 cancer related surgeries, which were paid for by the breast/cervical cancer Medicaid program. Unfortunately, follow up care and monitoring aren't covered and I was dropped from Medicaid. I'm now on my husband's health insurance, which is basically worthless because our income is under $20,000/yr and the policy has a $4500 deductible plus 20% after. I haven't seen my oncologist for over a year because we can't afford the expensive scans, biopsies, and lab work associated with cancer follow-up with a deductible that high. I thought my situation would change in 2014 with Obamacare. I recently learned from the healthcare.gov website calculator that our income is low enough to qualify for expanded Medicaid (which our state decided not to expand), but I don't qualify for the health insurance subsidies I desperately need because the outrageous deductible health insurance from my husband's job covers spouses. How can a couple with an income so low they would qualify for expanded Medicaid be ineligible for subsidies? I am completely devastated over this and I don't know what to do. Not being able to afford cancer follow up care is putting my life in danger. Even if my husband's employer (Walmart) quit covering the spouses of full-time employees, I think that would only apply to new hires because of the grandfather clause. If getting subsidies was based on income alone the way it should be instead of access to employer provided coverage, I would qualify for a zero deductible policy and $3 co-pays with a monthly premium of around $60. I could then afford the expensive health care I need. We live in a college town so if my husband got a different job, he'd make even less than he does now and we would probably end up homeless. If my husband transfers and we move to a state that's expanding Medicaid, I'll have to quit school and get rid of my German Shepherd and Siberian Husky since it's almost impossible to find a landlord that allows them. We thought another option might be to get a divorce on paper and co-habitate until our situation changes (completing my degree and getting a good job so I can afford the deductible), then re-marry. When I asked about that, someone actually accused me of wanting to commit fraud! How can anyone think of something like fraud when a situation is endangering someone's life? Today I got pulled over for the first time for running a red light , when the officer pulled me over, as he was getting off his bike I took my seatbelt off (I know, now that I think of it, it was such a stupid thing to do, but it was my first time being pulled over and I didnt know how to react). He di.dn't say anything about the seatbelt, but he told me that I ran the red light back there. Ok, let me explain this to you guys now, i don't know if you're familiar with Cape Cod or not but there are TONS, literally tons of tourists here right now, and the roads are really narrow.. There was a guy in an Audi pulling into a parking spot in reverse in front of me and he was taking half of the lane that I was on.. This parking spot happens to be 10 ft away from the set of lights. In my mind I was thinking, I'm gonna go to the left side to let this guy go in, and while that was happening I was worried about the tourists that like to jaywalk and cross the road inbetween cars... So I go to the left and the left and gas it a little bit, I was going like 10 mph as I was taking off, and the light turns yellow, I cross the crosswalk, then the light turns red and I drive under the set of lights.. These 2 bike cops came immediately after me... So long story short, it was my first time being pulled over, I took the seatbelts off, and I ran the red light because there was a guy pulling into a parking stop right in front of me and I was too worried looking around afraid I was going to hit a jaywalking tourists. I know people always think they're right, but I honestly think I didn't do anything wrong here. I got a $25 seat belt fine and a warning for running the red light, which is complete BS. I know it's a warning but I don't want it on my record at all, how can I appeal, any tips? Im only 18 years old, just got off my JOL and I'm very conscientious of other people, never speed or anything. I appreciate your help, will give best answer, thanks!

Evidently my insurance co made out the check to both myself and my mortgage bank (too bad I didn't realize it before I deposited it at the ATM this morning...) for siding and roof hail damage. I was on hold for over 40 minutes today waiting to talk to a rep at the mortgage bank (PNC). I hung up and will call back tomorrow when I have more time to listen to bad music. What's the normal procedure for handling this? The check was only for $6800. I may hold off a bit on some of the repair, and do some of it myself. I've already made arrangements for a window replacement ($900 vs the $450 the ins co gave me). There's a PNC Bank just down the street. Any ideas on whether they can handle it there?

my 2009 vauxhall insignia was hit from behind sitting at a car park space in a supermarket,there is substantial amount of damage to the right hand arch right above the back wheel,the back bumper is also broken,it was hit that hard it was pushed onto the car park space in front of it,i believe what saved it from any further damage was the driver of the other car hit the wheel of my car which i guess cushioned the blow.i have went today and got estimates for the repair which is in the region of 2500 pounds though could be more as they have to put it on some sort of machine to see if the wheel alignment is of,the repair shops say what they will do is cut the arch out and put a new arch in and spray it but no matter what its never going to be the same.the reason they do it like this is because the whole back of my car runs to the front without any splits. Im not happy about this being done like this as this car today is worth around 10,000 pounds which i pay for and dont want it patched up,i would prefer if the other guys insurance wrote it off so that i can get an original car which i first had,is there anyway i can get this to be wrote of and claim it of the guys insurance,i have heard of depreciation money if my car has been hit but this is still not going to compensate me for my car being patched up. thanks

I just bought a 1995 CBR F3. My first bike I got last year was a klr250, rode it since last summer all year (no car for me), even rode in the snow for the hell of it. For the CBR, my insurance im looking at is going to be 200 a year without anything, only the minimum liability. We bought a 2011 Lancer on Dec 8th 2010. On Dec 27th 2010, we slid off the road in a blizzard, but the car was not damaged AT ALL. The car was parked and only had our pets and christmas gifts from the holidays. An idiot speeding in a snow storm made a b-line into our car. Both ours and their insurance determined the car totaled and the other driver was found at fault by his insurance company. We did have GAP coverage (which will NEVER happen again). The car was 19 days owned and we believe we should get MSRP for our car. Does anyone know if this is reasonable? I think we pay so much every month and therefore are entitled to be in the same position financially as we were before the accident. (Also, we had stuff : a rifle, our pets, their crate that got damaged. We were wondering if that and the out-of-pocket rental car expenses should be covered... seeing that it was in direct relation to the car accident, that was his fault.)

Please help! I am not a thief and have never been one although my current insurance company think I am. My car was stolen from my house in March this year and NRMA have denied the claim stating that i was untruthful in my claim. I have had 2 cars and and home and contents insurance for 7 years and never made a claim in my life. etc etc etc. They are saying the a correctly coded key was used to drive the car away and there is no possibility that someone other then me would have a key for it. Basically, its all a load of crap. I have tried appealling it with the insurance company but once again been denied. The case is now with the insurance obundsman and I will will be taking them to court if the claim is not finalised in my favour by the obundsman. The policy for my husbands car is due and NRMA are not renewing and I have tried gaining other insurance with different companies but as soon as I explain the story, no one will touch me. I know I have to be honest in case we have a claim in future and if we lie they wont approve the claim. I cannot be without insurance for my house or cars but i have been totally blacklisted from NRMA. So I am asking, are there any insurance companies that will cover us under these circumstances? Or has anyone had a similar situation that could help with some advise. In addition, the police who investigated the theft (after receiving the forensic information) told me they couldn't charge me with lying to the police because they had no proof... All my friends are with Quinn Direct, and their 1.3L Fiesta's etc are only 1900 to insure! Gocompare and all those don't give me much better quotes either. I've also done the Pass Plus. I got a new auto insurance begining June. And I had an hail damage and hit and run case towards the end of June. On July 30 there was an accident, other person involved was at fault as he rear-ended my car. I reported all these occurances. I get a involuntary cancellation of the auto insurance policy after a couple of days. They sent me this notice and also made me aware of the right to dispute this with the State commisoner for Insurance. Now, when I go shopping for new insurance, I get an increased premium quote. None of the reported claims are my fault and I do not know if I have to dispute this case with the commisioner for insurance or not and not sure how much money I have to spend towards it.
